PROCESS SERVICE:
SUMMONS and COMPLAINT

Simply speaking, when people are sued, they are Summoned,
or "Served With A Summons" as a means of notifying them that a
lawsuit has been filed against them. This is a function of
the "due process" that is an important part of the American justice system. A Complaint is also given to the person being sued. This is the document that outlines the specific things that the Court is going to be asked to remedy. In Florida, there are only two entities that can serve Summons and Complaints: local sheriff's departments, and Certified Process Servers. The staff of Baker Street Process Service and Baker Street Investigations, are fully qualified and experienced Certified Process Servers.

OUR QUALIFICATIONS:
|
|
Besides decades of experience embodied in the joint venture
of Baker Street Process Service and Baker Street Investigations, we have to go to school -- literally. In
Florida's 19th Judicial Circuit, where we are based, process servers are required to go to college to study the state statutes, federal regulations, and specific 19th Circuit rules for process service. We also have to take and pass a comprehensive examination prescribed by the Chief Judge. Only then are we certified to serve summons, complaints, and subpoenas as authorized by the Court. (In many areas, Certified Process
Servers are "Officers of the Court," although this is not
the case in the 19th Judicial Circuit.) |

SUBPEONAS
|
|
Although Subpoenas look and are served much like Summons
and Complaints, they are different in that they require that
something be done.... The most common Subpoenas that we serve
involve the production of materials such as financial records.
Sometimes, they require a person to attend an information gathering interview called a deposition. |

6-DAYS A WEEK:
|
|
In Florida, the statutes permit Certified Process Servers
and sheriff's deputies to "serve papers" midnight Monday through midnight Saturday. Unless there is a special exception ordered by a judge under unique circumstances, no Summons and Complaints and no Subpoenas may be served in our state on Sunday.

WE SERVE PAPERS ALL ACROSS THE NATION

While Baker Street Process Service and Baker Street Investigations is certified to perform process
serving functions anywhere in Florida's 19th Judicial District, we are a nationwide agency. We have affiliated process servers located throughout the United States. (In some states, there are no Certified Process Servers and, in those cases, we have relationships with Sheriff's Departments, which may perform this service.)

| WHAT WE SAY WHEN WE
SERVE
PAPERS

When people are notified that they are being sued (or required
to perform whatever a Subpeona demands), there is a great deal
of trauma. Baker Street Process Service and Baker Street Investigations' Certified Process Servers are highly
professional and very sensitive. As we approach the person to
be served, we carry our Photo ID badge, identifying
ourselves as being Certified Process Servers through the 19th
Judicial Circuit Courts. We explain that, while we are sorry to have to do so, we have some legal documents that must be
served. We then take the time to carefully explain that the
person being served may want to consult an attorney. And, we
show them where, in the paperwork, it tells them that they have
a specific period in which to respond (in legal terms, this is
called an "Answer").

WHEN WE CAN'T FIND THE PERSON TO BE
SERVED
|
|
While most Certified Process Servers are not, we are also
Private Investigators, licensed by the State of Florida. As private detectives, we have the extensive training
and technological resources needed to conduct searches to locate difficult-to-find people in order to serve them. |

| AFTER THE PAPERS HAVE
BEEN SERVED
|
|
After the Summons and Compliant, or the Subpoena (sometimes a
Writ) has been served, we provide a "Return of Service" document to the court attesting to the time, date, and means by which the requisite papers were presented (served). The staff of Baker Street Process Service and Baker Street Investigations are well known and respected for our timeliness and accuracy
throughout this process.
